M. CLERY ACT

The Jeanne Clery Act requires institutions to have a public crime log and warn the campus community about crimes that pose a threat to students and employees. For further information about this law, go to http://www.securityoncampus.org/schools/cleryact/

As part of this law, institutional staff members are obligated to report to the appropriate authorities (Athletics administrator or Public Safety) any crimes, committed on any property owned by the University or adjacent public property, about which they become directly, or through second-hand information, aware.

All crimes in each of the following categories must be reported:

Murder/Non-Negligent Manslaughter

Negligent Manslaughter

Sex Offenses &endash; Forcible

Sex Offenses &endash; Non-forcible

Robbery

Aggravated Assault

Burglary

Motor Vehicle Theft

Arson

(Simple Theft is not required to be reported by the Clery Act, but is of concern to Athletics administration if it occurs on department-controlled premises.)

Staff members are also required to report annually the number of persons (students or employees) who have been referred for internal disciplinary action involving the violation of Liquor, Drug Abuse or Weapons Possession Laws.

In all cases, Public Safety must ultimately be informed. This is not an area in which confidentiality, requested by a victim or third party, can be honored. Victims should also be strongly encouraged to report the crime directly to the authorities.
